1. Acceptance of Terms

Welcome to GenPost. By accessing or using the GenPost platform (the "Service"), available at genpost.xyz, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and GenPost ("we," "us," or "our"). We encourage you to read these Terms carefully before using the Service. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes.

2. Description of Service

GenPost is an AI-powered content marketing platform designed to help businesses and individuals create, manage, and publish digital content. The Service provides the following capabilities:

• AI-generated blog posts, social media content, and Google Business Profile (GBP) posts
• AI-powered image generation for use alongside written content
• Automated and scheduled publishing to connected platforms, including Meta (Facebook and Instagram)
• Campaign management tools for organizing and planning content strategies
• Integration with third-party services for content distribution

The features and functionality of the Service may change over time as we continue to improve and expand the platform.

3. Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information. You agree to the following:

• You must be at least 18 years of age to create an account and use the Service.
• You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your login information with any third party.
• You are fully responsible for all activity that occurs under your account, whether or not authorized by you.
• You must promptly notify us at genpostsupport@gmail.com if you become aware of any unauthorized access to or use of your account.
• You agree to keep your account information up to date at all times. Providing false or misleading information may result in suspension or termination of your account.

4. Subscription & Billing

GenPost offers the following subscription plans:

• Basic Plan — $50.00 per month
• Pro Plan — $80.00 per month

All subscriptions are billed on a recurring monthly basis. By subscribing, you authorize GenPost to charge your designated payment method at the beginning of each billing cycle until you cancel.

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. No partial or prorated refunds will be issued for unused time within a billing cycle.

We reserve the right to change our pricing at any time. If we change the price of your subscription, we will provide you with at least 30 days' notice before the new price takes effect. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.

5. AI-Generated Content

The Service uses third-party artificial intelligence models, including but not limited to Anthropic's Claude and Google's Gemini, to generate written content on your behalf. By using these features, you acknowledge and agree to the following:

• Review responsibility: All AI-generated content is provided as a draft. You are solely responsible for reviewing, editing, and approving all content before it is published or distributed.
• No guarantees: GenPost does not guarantee the accuracy, completeness, originality, or suitability of any AI-generated content. AI-generated content may contain errors, inaccuracies, or statements that do not reflect your views or intentions.
• No ranking guarantees: GenPost does not guarantee that AI-generated content will achieve any specific search engine ranking, engagement level, or marketing outcome.
• Content ownership: You own the content generated through the Service for your account. GenPost does not claim any ownership rights over content created for you by the platform.

6. Image Generation

The Service may use third-party AI image generation tools, including but not limited to Google Imagen and OpenAI's DALL-E, to create images for your content. By using these features, you acknowledge and agree to the following:

• AI-generated images are created using third-party services, and the availability and quality of these images may vary.
• You are solely responsible for ensuring that any AI-generated images you use comply with applicable laws, regulations, and third-party rights, including intellectual property and publicity rights.
• GenPost makes no representations or warranties regarding copyright ownership or exclusivity of AI-generated images. The legal status of AI-generated imagery may vary by jurisdiction.
• You agree not to use AI image generation to create content that is harmful, deceptive, defamatory, or that violates the rights of others.

7. Third-Party Integrations

The Service integrates with third-party platforms, including but not limited to Meta (Facebook and Instagram) and Google Business Profile. By connecting these services through GenPost, you acknowledge and agree to the following:

• Your use of third-party integrations is subject to the terms of service and privacy policies of those respective platforms. It is your responsibility to review and comply with those terms.
• You must have proper authorization to connect and publish content to any third-party account you link through the Service. You represent that you have the legal right to manage the accounts you connect.
• GenPost is not responsible for any changes, disruptions, or discontinuation of third-party APIs or services. Changes made by third-party providers may affect the availability or functionality of certain features within GenPost.
• GenPost is not liable for any actions taken by third-party platforms in response to content published through the Service, including content removal, account suspension, or policy enforcement.

8. User Content & Data

You retain full ownership of all content you create, upload, or generate through the Service ("User Content"). GenPost does not claim any ownership rights over your User Content.

By using the Service, you grant GenPost a limited, non-exclusive license to process, store, and transmit your User Content solely for the purpose of providing and improving the Service. This includes sending your data to third-party AI providers (such as Anthropic and Google) for the purpose of generating content on your behalf.

We do not sell, rent, or share your User Content with third parties for their own marketing or commercial purposes. Your data is used exclusively for the purpose of delivering the Service to you. For full details on how we handle your data, please refer to our Privacy Policy.

9. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree not to use the Service to:

• Create, publish, or distribute content that is illegal, fraudulent, defamatory, obscene, or otherwise objectionable.
• Generate or distribute spam, unsolicited bulk messages, or misleading content.
• Impersonate any person, business, or entity, or falsely represent your affiliation with any person or entity.
• Create content that promotes violence, harassment, discrimination, or hatred against any individual or group.
• Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
• Use the Service in any manner that could damage, disable, overburden, or impair the platform or interfere with any other party's use of the Service.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.

10. Intellectual Property

The GenPost platform, including its software, design, logos, trademarks, documentation, and all related intellectual property, is owned by GenPost and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the platform without our prior written consent.

As stated in Section 5 and Section 8, you retain ownership of content generated through the Service for your use. Nothing in these Terms transfers any of your intellectual property rights to GenPost.

11. Limitation of Liability

To the maximum extent permitted by applicable law, GenPost and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.

In no event shall GenPost's total aggregate liability to you for all claims arising out of or related to these Terms or the Service exceed the total amount you have paid to GenPost in the twelve (12) months immediately preceding the event giving rise to the claim.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless GenPost and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you create, publish, or distribute through the Service; or (e) your infringement of any third-party rights, including intellectual property rights.

13. Termination

Either party may terminate this agreement at any time. You may cancel your account by using the cancellation option in your account settings or by contacting us at genpostsupport@gmail.com.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we determine that you have violated these Terms or if we discontinue the Service.

Upon cancellation or termination, your right to use the Service will cease immediately. We will retain your account data for a period of thirty (30) days following termination, during which time you may request an export of your data. After this 30-day retention period, your data will be permanently deleted and cannot be recovered.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least thirty (30) days' notice before the updated Terms take effect. Notice may be provided via email to the address associated with your account, through an in-app notification, or by posting the updated Terms on our website.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account before the changes take effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Illinois, and you consent to the personal jurisdiction of such courts.
